RELEASE OF LIABILITY

I acknowledge that horseback riding & related activities including being a spectator at horse events carries inherent risks of injury & damage to me, to my minor child(ren) to my personal property & risks of injury or death to my horse(s) caused by my own negligence or the negligence of others. I knowingly assume all risks, whether known or unknown, of horseback riding & its related activities.

I hereby waive, release, & discharge MARILYN OPHEIM and GARY OPHEIM (hereinafter referred to as the OPHEIMS) from all liability for any act of negligence or want of ordinary care on the part of the OPHEIMS or any of its agents. In consideration of my participation in the events organized or sponsored by OPHEIMS, I waive, release, & discharge OPHEIMS, agents, employees, volunteers, their representatives, heirs, executors, & assigns from any & all claims, loss, damage, liability or injury resulting from my participation, including but not limited to damage to my personal property and/or injury or death that might be sustained by me or my family or guests, & from any or all claims of any kind or nature that might occur as a result of, or arising from my participation, or as a spectator. This agreement is binding on my executors, heirs & assigns.

I expressly waive any rights I may have under California Civil Code 1542, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." I agree that I will indemnify and hold harmless and defend OPHEIMS, their officers, officials, directors, employees, agents and volunteers against all claims, demands, and causes of action, including court costs and actual attorney fees, arising from any proceeding or lawsuits brought by or prosecuted for my benefit, in which this release is upheld.

I, the undersigned parent or guardian of the participant named below, in consideration of my minor's participation in the event, have read, understand, and agree that the terms & conditions of this Release of Liability shall be binding as to damage or injury to my minor, his animals, & property arising out of his participation in events. I acknowledge that I have read this Release of Liability & know & understand its content.
